Restoring a classic car in Michigan

A restoration in Michigan touches three sets of rules: the Department of State (titles, plates and repair-shop regulation), Treasury (sales and use tax), and the statute that decides who can hold your car while a bill is unpaid. Winter matters too, since Michigan road agencies spread hundreds of thousands of tons of salt on state highways each year, so a corrosion check belongs at the start of any project.

Sales tax on restoration work

Michigan's 6 percent sales tax applies to the parts and materials a shop sells you. Labor for maintenance and repair of someone else's property is left out of the taxable price only if it is itemized separately on the bill. If a shop quotes one lump figure, the whole amount can be taxed. The statute carves out repair and maintenance labor specifically, so labor that goes into making a new part is not covered by that exclusion. Ask for repair labor, parts, materials and any fabrication on separate lines. Michigan use tax reaches taxable property brought into the state for use here, with credit in some cases for tax already paid to another state.

Rules for restoration shops

Under the Motor Vehicle Service and Repair Act, a business that does maintenance, diagnosis, body work or repair for pay must be registered with the Department of State, display its certificate, and print its registration number on estimates and invoices. Before work starts the shop must give you a written estimate that itemizes labor and parts. It cannot charge more than the estimate without your consent, except that an overrun of no more than 10 percent or $50, whichever is less, does not need new approval unless you ask for it. Any diagnosis charge has to be in the estimate. The shop must return replaced parts at completion, and give you a signed written statement of what was done, with parts identified as new, used, rebuilt or reconditioned. An unregistered shop cannot sue for payment or claim a garage keeper's lien, and the customer can recover what was paid to it. A restoration is rarely one job, so many owners ask for a fresh written estimate for each phase.

When a bill goes unpaid

A shop that holds your car has a garage keeper's lien from the day of the last labor. It may keep the vehicle for no more than 225 days. To sell it, the shop must apply to the Department of State within 105 days for a certificate of foreclosure, send certified-mail notice giving the owner at least 30 days to pay, and hold the sale no sooner than 75 days after the certificate date. The Department of State can object if the shop broke the repair act. You can redeem the car by paying before the sale, and surplus proceeds go to the owner. The lien does not cover labor and materials for custom parts not normally available from the manufacturer or installed by it, which matters on modified cars. Storage is capped at $10 a day for up to 120 days unless agreed otherwise in writing.

Titling a project car

Michigan wants a title to sell a vehicle, and a transfer must be filed within 15 days of the sale. If the paperwork is missing, the Department of State may require a surety bond of twice the value for a vehicle worth over $2,500 or under 10 years old; for an older vehicle worth $2,500 or less the applicant certifies ownership. A car rebuilt from parts is an assembled vehicle: you need ownership documents for the engine, transmission, body parts, frame and axles, a police inspection, a Department of State inspection, and a new VIN for $10. A salvage-titled car cannot be plated until it passes a salvage inspection, after which the title reads Rebuilt Salvage permanently.

Plates, inspection and engine swaps

A historical plate costs $30 and is for cars at least 26 years old owned as collector's items. It allows club events, exhibitions, tours, parades and mechanical testing, not routine transportation, though the restriction is suspended from Memorial Day to Labor Day. The owner certifies the car was inspected and found safe, and Michigan No-Fault insurance is required. The plate does not pass to a buyer. The titling pages list no routine emissions test or safety inspection, and the state's emissions-testing statutes apply only if triggered as an EPA-approved contingency. Federal law still treats an engine swap as tampering unless the car matches a certified configuration of the same or newer model year as the chassis.

Michigan classic car restoration FAQ

Is labor taxable when a shop restores my classic in Michigan? +

Repair and maintenance labor on your own car is excluded from the 6 percent sales tax when it is itemized separately on the bill. Parts and materials the shop sells you are taxable, and a lump-sum charge can make the whole amount taxable. Labor that fabricates a new part is not covered by the repair-labor exclusion.

Does a Michigan restoration shop have to register with the state? +

Yes. A business doing maintenance, diagnosis, body work or repair for compensation must register with the Department of State, display the certificate, and put its registration number on estimates and invoices. You can check the Department of State's public repair facility listing.

Do I get a written estimate, and can the final bill be higher? +

The shop must give a written estimate itemizing labor and parts before work begins. It cannot exceed the estimate without your consent, except for an overrun of up to 10 percent or $50, whichever is less, unless you asked to approve every increase. You can sign a waiver to skip the estimate, but it must be voluntary.

Can a shop keep my car if I dispute the bill? +

A shop can hold the car under the Garage Keeper's Lien Act, but only for up to 225 days after the last work and only if it followed the repair act. To sell it, it must go through the Department of State, send you certified notice, and wait at least 75 days after the certificate date. You can redeem the car by paying before the sale.

What do I need to title a restoration project that has no title? +

Michigan needs a title to sell a vehicle. For a vehicle with unclear ownership, the Department of State may require a surety bond of twice the vehicle's value if it is worth over $2,500 or is under 10 years old. Older vehicles worth $2,500 or less need an ownership certification. Check with a Secretary of State office before buying a car without a title.

Does Michigan require an emissions test for a restored classic? +

The Department of State titling and registration pages list no emissions test or periodic safety inspection. The state's emissions-testing laws for Southeast and West Michigan apply only under conditions tied to EPA-approved plans. Federal anti-tampering rules still apply to any engine swap.

Can I drive a classic on historical plates while restoring it? +
